Acceptance of terms
This website (the “Site”) includes all the information, documents, files, text, and graphics available through it (together, the “Materials”), plus any products or services SOLERA offers or runs through it (together, the “Services”). Both are available to you under these Terms of Use, along with any changes we publish here from time to time.
By using the Site in any way — using our Services, downloading Materials, or simply browsing — you agree to these Terms of Use and to the practices described in our Privacy Policy and Cookies Notice.
Intellectual property
The Materials and Services on this Site belong to SOLERA. They're protected by copyright, trademark, patent, and other intellectual property laws. Using them without permission may break those laws and these Terms.
Unless we say otherwise here, SOLERA and its suppliers grant you no express or implied rights to use the Materials and Services. You agree not to copy, republish, modify, rent, lease, loan, sell, assign, distribute, license, sublicense, reverse engineer, or build derivative works from the Site, its Materials, or its Services — except where we've clearly allowed it.
Parts of the Site are protected by trade dress, trademark, and other laws, and may not be copied or imitated in whole or in part. No logo, graphic, sound, or image from any SOLERA website may be copied or retransmitted unless we've expressly permitted it.
Use of the Services and Materials
Unless stated otherwise on the Site, you may use and print Materials — things like white papers, guides, datasheets, and FAQs — if you follow these rules:
- Use the Materials only for non-commercial or internal business purposes.
- Don't modify or alter them in any way.
- Don't create derivative works from them.
- Don't distribute, sell, rent, lease, transfer, or license them to others.
- Don't remove any copyright or proprietary notices.
- Understand that SOLERA can withdraw this permission at any time, and you'll stop using the Materials as soon as we tell you to.
When you use any Service on the Site, you also agree to any posted guidelines, rules, or licenses that apply to it, on top of these Terms. Among other things, you agree not to:
- Use the Services for surveys, contests, junk email, spam, or any duplicate or unsolicited messages.
- Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, including their privacy and publicity rights.
- Publish, post, upload, or share anything inappropriate, profane, defamatory, obscene, indecent, or unlawful.
- Upload files containing images, photos, or material protected by intellectual property law unless you own the rights or have the consent to do so.
- Use any material — images, photos, or anything else — in a way that infringes someone else's copyright, trademark, patent, trade secret, or other rights.
- Upload files containing viruses, Trojan horses, worms, corrupted files, or any code that could damage another person's computer or property.
- Falsify or delete author attributions, legal notices, or proprietary labels.
- Harvest or collect information about others, including email addresses.
- Break any applicable law or regulation.
User conduct while using the website
When you use the Site, its Services, and its Materials, you agree:
- Not to disrupt or interfere with anyone else's use of the Site or any linked sites.
- Not to upload, post, or transmit any viruses or other harmful, disruptive, or destructive files.
- Not to disrupt or interfere with the security of the Site — or any Services, Materials, system resources, accounts, passwords, servers, or networks connected to it.
You also agree not to use any data mining, robots, or similar data-gathering methods on the Site.
Links to other sites
We may link to other websites we think show useful examples of our work and services. Those sites don't follow the same privacy practices we do, and we're not responsible for their policies or their actions. Before you share any personal data with them, we'd encourage you to read their own privacy notices first.
Warranties and disclaimers
The Site, and all Materials and Services available through it, are provided “as is” to the fullest extent permitted by the law that applies to you. SOLERA does not guarantee the Site, Materials, or Services will be fit for a particular purpose beyond what's expressly agreed in a signed service agreement. Nothing in this section limits any statutory right or guarantee that the law of your country doesn't allow us to exclude.
Without limiting the above, SOLERA makes no warranty that:
- The Services and Materials will meet your requirements.
- The Services and Materials will be uninterrupted, timely, secure, or error-free.
- The results you get from using the Services or Materials will be effective, accurate, or reliable.
- The quality of any Services or Materials will meet your expectations.
- Any defects in the Site, its Services, or its Materials will be corrected.
- This Site may include technical or typographical errors and inaccuracies.
You understand and accept that:
- SOLERA does not control, endorse, or take responsibility for any content, products, or services offered by third parties through the Site, including third-party vendors and any third parties reached through links on the Site.
- SOLERA makes no representations or warranties about those third parties, their content, products, or services.
- Any dealings you have with those third parties are at your own risk.
- SOLERA is not liable or responsible for any content, products, or services offered by third parties.
Using the Services, or downloading or using any Materials, is done at your own discretion and risk. You're solely responsible for any damage to your computer system, loss of data, or other harm that results. SOLERA assumes no liability for any virus or similar code downloaded to your computer from the Site or in connection with any Services or Materials.
Limitation of liability
To the maximum extent permitted by applicable law, SOLERA, its subsidiaries, affiliates, agents, officers, directors, employees, partners, or suppliers will not be liable to you or any third party for any special, punitive, incidental, indirect, or consequential damages of any kind, including damages resulting from loss of use, data, or profits, whether or not SOLERA was advised such damages were possible. This limitation does not apply to, and nothing in these Terms excludes or limits, liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by SOLERA's negligence, or any other liability that cannot be excluded or limited under the law that applies to you.
Subject to that carve-out, this limitation applies on any theory of liability arising out of or connected to:
- Your use of, or inability to use, the Site, its Services, or its Materials.
- The statements or actions of any third party on or through the Site.
- Any dealings with vendors or other third parties.
- Any unauthorized access to or alteration of your transmissions or data.
- Any information sent, received, not sent, or not received.
- Any failure to store, or loss of, data, files, or other content.
- Any Services delayed or interrupted through the Site.
- Any website referenced or linked from the Site.
Governing law and jurisdiction
These Terms of Use, and any dispute or claim arising out of or in connection with them or the Site, are governed by Spanish law. Subject to any mandatory consumer-protection rules that entitle you to bring a claim in your own country of residence, the courts of Málaga, Spain, have exclusive jurisdiction over any such dispute.
Changes to these Terms and contact information
We may change these Terms of Use at any time. When we do, we'll post the changes on this page. If you have questions about these Terms, our Privacy Policy, or our Cookies Notice, get in touch at info@soleraway.com.
We aim to respond to all legal, privacy, and Terms of Use enquiries within one month of receiving your request. If your request is complex or requires more time, we'll let you know within that period — including the reason for the delay and when you can expect a full response. We won't charge for handling your request unless it is clearly excessive or repetitive, in which case we'll explain our position before taking any action.
Entire agreement
These Terms of Use, together with the other rules, guidelines, licenses, and disclaimers posted on the Site — and our Privacy Policy and Cookies Notice — make up the entire agreement between SOLERA and you regarding your use of the Site.
If a court of competent jurisdiction finds any provision of these Terms unenforceable, that provision will be enforced to the maximum extent permitted, to reflect the intent of the parties, and the rest of these Terms will stay in full force and effect. If SOLERA fails to enforce any provision or right, that isn't a waiver of that provision or right.
